Terms & Condition

Please read the booking conditions carefully. They set out your agreement with TrekandTours and contain important information. By booking with us and paying your deposit you are agreeing to the Terms and Conditions outlined below. If you do not understand these Terms and Conditions please contact us for clarification.

 

Booking Confirmation and Payments

In order to confirm your booking, you are required to complete a booking form and make a deposit payment of 30% for Nepal, 50% for Bhutan, India and Tibet trip. Final payment is due 90 days (or as stated by us) prior to the departure date of the trip. Where possible TrekandTours will accept your last minute booking prior to tour departure date full payment is then required. Please contact us for direct deposit details. A bank service charge may apply and should be paid at the time of deposit.

 

Age Limit/ Child Policy

Our bookings are open to people 8 years of age and over. Travellers under 18 years of age must be accompanied at all time by an adult throughout the trip and cannot be left unsupervised. An accompanied child remains the sole responsibility of the adult at all times and TrekandTours cannot be liable for any incidents and accidents while travelling with TrekandTours.

Booking Transfer or Cancellation by you (The Client)

If it becomes necessary to cancel your trip, we ask that you notify us immediately in writing. Cancellation will take effect upon receipt by TrekandTours of your written notice. If the cancellation is made more than 90 days prior to the trip departure date, you will forfeit the deposit. However, your trip may be postponed to a different date for a fee of USD$100. Postpone of bookings are subject to availability and are only valid on trips that depart within 12 months from the date of postponed. Only one postpone of your deposit to another trip departure date is permitted. If you cancel the second trip, your deposit is forfeited. For postponed departure date, you must pay the price difference between the originally booked trip and the new departure date trip (if there are any changes in price).

Changes to your Holiday and Pricing

Traveling with TrekandTours requires a degree of flexibility, and an understanding that modes of transport, accommodation and itineraries may change, even after the trip has commenced, without prior notice due to local circumstances such as flight delay, cancellation or postponement due to adverse weather in the Himalayan regions or other unpredictable circumstances such as land-slides, road blockage, flood, snow, political unrest or delay arrival etc. TrekandTours is unable to provide any refund under the above circumstances due to prior supplier arrangements. We do not accept any responsibility for the loss of employment, delays or compensation resulting from situations beyond control.

TrekandTours reserves the right to revise pricing posted in our marketing material or to impose surcharges up to 60 days before departure, under any circumstances, or on the pressure of various external factors that are further than our control, for instance, changes in exchange rate, government action etc.

TrekandTours reserves the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, the additional cost of any necessary itinerary alteration will be covered by you (client). TrekandTours will not be responsible for any incidental expenses that may be incurred as a result of the change itinerary.

Mandatory Travel Insurance

Due to the adventurous style of travel offered by TrekandTours and the remoteness of the areas in which we travel, it is, therefore, a condition of travel with TrekandTours that all travellers are adequately covered by travel insurance prior to departure. Insurance should cover cancellation charge, trip interruption, emergency rescue operation, medical expenses, personal accident and medical expenses, baggage loss. Your insurance details must be supplied to TrekandTours prior to your trip departure.

Cancellation by TrekandTours

Despite anything else in this Agreement, TrekandTours reserves the right to cancel any trip prior to departure in which case any payment made by you will be refunded in full and you will not be entitled to make any further claims related to such a cancellation, including but not limited to compensation or damages, for any loss, loss of time.

Medical Assessments

It is your responsibility to advise TrekandTours of any pre-existing medical conditions and/or disability that might reasonably be expected to increase risk of you requiring medical attention, or that might affect the normal conduct of the trip and negatively impact other trip members.

Photographic Consent and Release

By travelling with TrekandTours, you extend permission to us to take your photograph during the trip, and you release all rights over those images without further consideration. You understand and consent that TrekandTours may use images, feedback provided by you for future publicity in any media and promotional material. Any traveller who does not wish to be photographed must advise TrekandTours in writing prior to trip commencement.

Authority

At all times, the decision of the TrekandTours will be final on all matters likely to affect the safety and well-being of trip members and the trip. This includes any decision that the TrekandTours makes about the client’s ongoing participation in the trip or certain activities that comprise part of the trip. If the client fails to comply with a decision made by the TrekandTours or interfere with the well-being of the group, TrekandTours reserves the right to terminate this Agreement and order the client to leave the trip immediately, with no right of refund and TrekandTours will not be liable for any compensation, costs, damages or losses arising from such termination.

Risk and Liabilities

You (client) acknowledge that the nature of the trip is adventurous and participation in such trip involves a degree of personal risk. TrekandTours is committed to providing the best services which will give you a once in a lifetime journey in this connection, we perform our duties honestly and seriously to make your journey very smooth and pleasant. However, the entire programs in Nepal are conducted strictly under the rules and regulation of theirs’ own policies. Therefore TrekandTours and its related organization shall not be responsible for any changes in the itinerary due to unavoidable circumstance such as govt. restriction, Land slide, road blockage, flood, snow, political unrest, cancellation of flight, delay, sickness or accident, any extra cost incurring there of shall be borne by the clients on the spots.

Passport and Visa

All clients must have a valid passport with at least 6 months validity from return date. Nepalese visas can be obtained from the Nepalese Consulate in your country or arrival in Kathmandu Airport.
